safedesignateddriver.com (“Safe Designated Driver" or “Safe Designated Drivers") may change these Terms & Conditions of Use from time to time, so please be sure to check back periodically. Safe Designated Drivers is not a taxi or limousine service, but is a designated driving service mainly to get impaired drivers off our roads. Safe Designated Drivers is an alternative way of people getting home with their car. Impaired means but is not limited to; alcohol, prescription or medically unable, simple fatigue or you just don’t feel like driving. Drive in the comfort of your own car and arrange to get home with our professional team of drivers.

The terms “we”, refers to “Safe Designated Drivers” The term “you” or “patrons” refers to the members, customers, passengers, purchasers, and clients visiting the website and or booking a reservation through us on this website, or through our customer service agents. Each driver of Safe Designated Drivers will carry a copy of these Terms and Conditions of Use and will be made available to you upon request.

If you do not agree with any of the terms of use below, please do not use this site. Safe Designated Drivers reserves the right, at any time, to modify, alter or update these terms of use. You agree to be bound by such modifications, alterations or updates.

All materials on this site, including for example: images, illustrations, promotions and terminology, is protected by copyrights which are owned and controlled either by Safe Designated Drivers, or by third parties who have licenced their materials to us.

Any material from Safe Designated Drivers may not be copied, downloaded, reproduced, uploaded, posted, transmitted or distributed in any way.

Modifications of the materials or use of the materials for any purpose other than your own personal, non-commercial, home use is a violation of the copyrights and other property rights held by Safe Designated Drivers. The use of any such material on any other website is specifically prohibited. The trademarks and logos, which you see on this site, are registered and unregistered trademarks of Safe Designated Drivers. Nothing on this site grants you any license or right to use any trademark displayed on this site without the written permission of the owner of the trademark. Your use of the trademarks displayed on this site, or any other content on this site, is strictly prohibited.

USE OF WEBSITE:

As a condition of your use of this website, you may warrant that:
(i) You are at least 18 years of age
(ii) You possess the legal authority to create a binding legal obligation.
(iii) You will use this website in accordance with the terms and conditions.
(iv) You will only use this website to make legitimate reservations for you or for another person for whom you are legally authorized to act.
(v) You will inform such other persons about the terms and conditions that apply to the reservations you have made on their behalf, including all rules and restrictions applicable there to.
(vi) All information is supplied by you on this website is true, accurate, current and complete.
(vii) We retain the right, at our sole discretion, to deny access to anyone to this website and the services we offer, at any time and for any reason, including, but not limited to, for violation of our Terms of Conditions of Use.
(viii) A cancelled reservation made through our dispatch center must be made within 2 hours before the scheduled pick up time.

USE OF SERVICE:

Safe Designated Drivers service can be requested by calling our dispatch center at +18554210671 and paying for your designated ride in full.

As a condition of our service, you warrant that each time you call our call centre agents or reserve our services online:
(i) you are authorizing that you are the rightful owner or leasee with signing authority of the vehicle that is being used for transport by our drivers.
(ii) All registrations, insurance, ownership, stickers are up to date.
(iii) That you agree that a taxi will be called if no proper registration, insurance, ownership, or stickers are shown

(iv) you are giving permission to our professional driver of Safe Designated Drivers to drive you and your vehicle home.
(v) Drivers of Safe Designated Drivers will only drop you home or to another place of accommodation
(vi) Any patron(s) that are with you to be dropped off there will be an additional charge of $5.00 for each stop based on proximity to the drop off location, provided seatbelts can be worn and each passenger can be transported safely.
(vii) As a member and the owner of the vehicle you will be dropped off last when you have patrons with you.
(viii) There must be enough fuel in your vehicle to get you to your drop off location.

(ix) You must agree not to make any physical contact with the drivers of Safe Designated Drivers at any time
(x) The drivers of Safe Designated Drivers can refuse to offer you or any other person service if they feel unsafe because of:
(a) impairment or someone is unconscious

(b) someone being armed, belligerent, violent, verbally or physically threatening or abusive
(c) the vehicle is unsafe to drive
(d) or any other facts relevant to the drivers safety, as determined in drivers sole discretion
(e) physically threatening or abusive
or
(f) any other facts or circumstances relevant to the driver’s safety, as determined in driver’s sole discretion.

When using Safe Designated Drivers service, you must agree to wear your seatbelt and obey all laws and regulations of the Ministry of Transportation. Your vehicle must be in good working condition and in compliance with the applicable laws with no defects or conditions that may cause the vehicle to be unsafe to drive.

In the case of an emergency, while using our services, you agree to pay any expenses required to get your vehicle to its destination, whether it be:

(a) Fuel

(b) Towing or other mechanical failure

(c) Parking Fees

You agree to authorize Safe Designated Drivers to seek emergency medical care in the event you are injured or become ill while being transported to your destination. You are also authorizing Safe Designated Drivers to leave the car parked in the hospital parking lot in the event of an emergency. Your keys will be retained by Safe Designated Drivers Head Office until you or a member or an authorized party authorizes the release. You acknowledge that in exchange for the privileges and peace of mind associated with Safe Designated Drivers you hereby:

(a) release Safe Designated Drivers and its managers, employees, agents and drivers from any and all liability, including negligence, for any injury, including death or property damage that may occur in connection with Safe Designated Drivers service
and
(b) agrees not to initiate any legal proceedings against Safe Designated Drivers managers, employees, agents or Drivers with respect to any and all such claims or damages, which you are releasing.

You are aware that there are various risks involved in the Safe Designated Drivers service. Such risks include the travel risks associated with riding in a vehicle and giving control of a vehicle to another person. Despite these and the other risks, you want this service and are willing to agree to personally bear such risks, assuming full responsibility for any harm or damage that may result.

Safe Designated Drivers shall use all reasonable endeavours to get you to your destination safe, but shall not be liable for:

(i) any loss due to delays caused by road or traffic conditions beyond its control on the journey
(ii) any cancellations of any services and provide refunds in the event of
(iii) you shall indemnify Safe Designated Drivers against all losses, costs, damages and expenses arising from any act of omission of any passenger in your party
(vi) Safe Designated Drivers provides service subject to availability and assumes no liability should all drivers be booked at the precise time when service is requested.

ADDITIONAL CHARGES:

Any variations to the pick-up and drop off address than what was agreed upon at the time of booking, will incur an additional charge of $5.00.

There will be a $0.50 per minute “Waiting Time” charged after your 5 minute “Grace Period” of the driver’s arrival time.

PLEASE NOTE: Safe Designated Drivers will call or text with an estimated time of arrival as well as when they have arrived at the pick up location.

A 50% surcharge will be billed to any pick-ups on National or Statutory holidays such as Canada Day, Christmas Day, Boxing Day, New Year’s Eve and New Year Day.
